Les présentes Conditions Générales d'Utilisation (CGU) régissent l'accès et l'utilisation de l'application mobile et web ApiSwiss, éditée par Flowbiz Sàrl (ci-après « ApiSwiss » ou « nous »).
2. Acceptation des conditions
L'utilisation de l'application implique l'acceptation pleine et entière des présentes CGU. Si vous n'acceptez pas ces conditions, vous ne devez pas utiliser ApiSwiss.
3. Description du service
ApiSwiss est une application de gestion apicole destinée aux apiculteurs suisses. Elle propose :
- Version gratuite : gestion des ruchers et ruches, journal de visite, signalement du frelon asiatique, guide apicole
- Version Pro (sur abonnement) : marché apicole, messagerie, réservation d'experts, analytiques avancés, inventaire médicaments
4. Compte utilisateur
- Vous devez être âgé d'au moins 16 ans pour créer un compte.
- Vous êtes responsable de la confidentialité de vos identifiants.
- Vous vous engagez à fournir des informations exactes et à les maintenir à jour.
- Tout usage frauduleux ou abusif entraîne la résiliation immédiate du compte.
5. Abonnement Pro
- L'abonnement Pro est proposé à 5 CHF/mois, renouvelé tacitement.
- Un essai gratuit de 30 jours est disponible sans engagement.
- Le paiement s'effectue par virement bancaire ou Twint (référence obligatoire).
- L'annulation prend effet à la fin de la période en cours.
- Aucun remboursement n'est accordé pour les périodes entamées.
6. Obligations de l'utilisateur
Vous vous engagez à ne pas :
- Publier des contenus illégaux, offensants ou trompeurs
- Tenter d'accéder aux données d'autres utilisateurs
- Utiliser l'application à des fins commerciales non autorisées
- Reverse-engineering ou extraction du code source
7. Propriété intellectuelle
L'application ApiSwiss, son logo, ses contenus et son code source sont la propriété exclusive de Flowbiz Sàrl. Toute reproduction non autorisée est interdite. Les données apicoles saisies par l'utilisateur lui appartiennent.
8. Limitation de responsabilité
ApiSwiss est fourni « tel quel ». Flowbiz Sàrl ne peut être tenu responsable :
- D'une perte de données due à une défaillance technique
- D'interruptions temporaires du service
- De décisions apicoles prises sur la base des données de l'application
La responsabilité de Flowbiz Sàrl est limitée au montant des abonnements payés au cours des 12 derniers mois.
9. Résiliation
Vous pouvez supprimer votre compte à tout moment depuis l'application. Flowbiz Sàrl se réserve le droit de suspendre ou résilier tout compte en cas de violation des présentes CGU.
10. Droit applicable
Les présentes CGU sont soumises au droit suisse. Tout litige relève de la compétence exclusive des tribunaux du canton de Fribourg, Suisse.
11. Modifications
Flowbiz Sàrl peut modifier les présentes CGU à tout moment. Les utilisateurs seront notifiés au moins 30 jours avant l'entrée en vigueur des changements substantiels.

2. Annahme der Bedingungen
Die Nutzung der Anwendung setzt die vollständige Akzeptanz dieser ANB voraus. Wenn Sie diesen Bedingungen nicht zustimmen, dürfen Sie ApiSwiss nicht nutzen.
3. Beschreibung des Dienstes
ApiSwiss ist eine Bienenhaltungs-Management-App für Schweizer Imker. Sie bietet:
- Kostenlose Version: Verwaltung von Bienenständen und -stöcken, Besuchstagebuch, Hornissenmeldung, Imkerguide
- Pro-Version (Abonnement): Imkermarkt, Messaging, Expertenreservierungen, erweiterte Analysen, Medikamenteninventar
4. Benutzerkonto
- Sie müssen mindestens 16 Jahre alt sein, um ein Konto zu erstellen.
- Sie sind für die Vertraulichkeit Ihrer Zugangsdaten verantwortlich.
- Sie verpflichten sich, genaue Angaben zu machen und diese aktuell zu halten.
- Betrügerische oder missbräuchliche Nutzung führt zur sofortigen Kontokündigung.
5. Pro-Abonnement
- Das Pro-Abonnement wird für CHF 5/Monat angeboten und automatisch verlängert.
- Eine kostenlose 30-tägige Testphase ist ohne Verpflichtung verfügbar.
- Die Zahlung erfolgt per Banküberweisung oder Twint (Pflichtangabe erforderlich).
- Die Kündigung tritt am Ende der laufenden Periode in Kraft.
- Für bereits begonnene Perioden werden keine Erstattungen gewährt.
6. Nutzerpflichten
Sie verpflichten sich, Folgendes zu unterlassen:
- Veröffentlichung illegaler, beleidigender oder irreführender Inhalte
- Zugriffsversuche auf Daten anderer Nutzer
- Nutzung der App für nicht genehmigte kommerzielle Zwecke
- Reverse Engineering oder Extraktion des Quellcodes
7. Geistiges Eigentum
Die Anwendung ApiSwiss, ihr Logo, ihre Inhalte und ihr Quellcode sind ausschliessliches Eigentum von Flowbiz Sàrl. Jede unbefugte Vervielfältigung ist untersagt. Die vom Nutzer eingegebenen Imkerdaten gehören ihm.
8. Haftungsbeschränkung
ApiSwiss wird „wie besehen" bereitgestellt. Flowbiz Sàrl haftet nicht für:
- Datenverlust durch technische Fehler
- Vorübergehende Dienstunterbrechungen
- Imkerliche Entscheidungen auf Basis der App-Daten
Die Haftung von Flowbiz Sàrl ist auf den Betrag der in den letzten 12 Monaten gezahlten Abonnements begrenzt.
9. Kündigung
Sie können Ihr Konto jederzeit über die App löschen. Flowbiz Sàrl behält sich das Recht vor, Konten bei Verstoss gegen diese ANB zu sperren oder zu kündigen.
10. Anwendbares Recht
Diese ANB unterliegen schweizerischem Recht. Für Streitigkeiten sind ausschliesslich die Gerichte des Kantons Freiburg, Schweiz, zuständig.
11. Änderungen
Flowbiz Sàrl kann diese ANB jederzeit ändern. Nutzer werden mindestens 30 Tage vor Inkrafttreten wesentlicher Änderungen benachrichtigt.

- Versione gratuita: gestione di apiari e arnie, diario di visita, segnalazione della vespa asiatica, guida apistica
- Versione Pro (abbonamento): mercato apicolo, messaggistica, prenotazione esperti, analisi avanzate, inventario medicamenti
4. Account utente
- È necessario avere almeno 16 anni per creare un account.
- Siete responsabili della riservatezza delle vostre credenziali.
- Vi impegnate a fornire informazioni accurate e tenerle aggiornate.
- L'uso fraudolento o abusivo comporta la risoluzione immediata dell'account.
5. Abbonamento Pro
- L'abbonamento Pro è proposto a CHF 5/mese, rinnovato tacitamente.
- È disponibile una prova gratuita di 30 giorni senza impegno.
- Il pagamento avviene tramite bonifico bancario o Twint (causale obbligatoria).
- La disdetta ha effetto alla fine del periodo in corso.
- Nessun rimborso viene accordato per i periodi già iniziati.
6. Obblighi dell'utente
Vi impegnate a non:
- Pubblicare contenuti illegali, offensivi o fuorvianti
- Tentare di accedere ai dati di altri utenti
- Utilizzare l'applicazione per scopi commerciali non autorizzati
- Effettuare reverse engineering o estrazione del codice sorgente
7. Proprietà intellettuale
L'applicazione ApiSwiss, il suo logo, i contenuti e il codice sorgente sono di proprietà esclusiva di Flowbiz Sàrl. Qualsiasi riproduzione non autorizzata è vietata. I dati apistici inseriti dall'utente appartengono all'utente stesso.
8. Limitazione di responsabilità
ApiSwiss è fornita "così com'è". Flowbiz Sàrl non può essere ritenuta responsabile per:
- Perdita di dati dovuta a guasti tecnici
- Interruzioni temporanee del servizio
- Decisioni apistiche prese sulla base dei dati dell'applicazione
La responsabilità di Flowbiz Sàrl è limitata all'importo degli abbonamenti pagati negli ultimi 12 mesi.
9. Risoluzione
Potete eliminare il vostro account in qualsiasi momento dall'applicazione. Flowbiz Sàrl si riserva il diritto di sospendere o risolvere qualsiasi account in caso di violazione delle presenti CGU.
10. Diritto applicabile
Le presenti CGU sono soggette al diritto svizzero. Qualsiasi controversia è di competenza esclusiva dei tribunali del Canton Friburgo, Svizzera.
11. Modifiche
Flowbiz Sàrl può modificare le presenti CGU in qualsiasi momento. Gli utenti saranno informati almeno 30 giorni prima dell'entrata in vigore di modifiche sostanziali.

3. Description of Service
ApiSwiss is a beekeeping management application for Swiss beekeepers. It offers:
- Free version: apiary and hive management, inspection diary, Asian hornet reporting, beekeeping guide
- Pro version (subscription): beekeeping marketplace, messaging, expert booking, advanced analytics, medicine inventory
4. User Account
- You must be at least 16 years old to create an account.
- You are responsible for keeping your credentials confidential.
- You undertake to provide accurate information and keep it up to date.
- Any fraudulent or abusive use will result in immediate account termination.
5. Pro Subscription
- The Pro subscription is offered at CHF 5/month, automatically renewed.
- A free 30-day trial is available with no commitment.
- Payment is made by bank transfer or Twint (mandatory reference required).
- Cancellation takes effect at the end of the current period.
- No refunds are granted for periods already started.
6. User Obligations
You undertake not to:
- Post illegal, offensive or misleading content
- Attempt to access other users' data
- Use the application for unauthorised commercial purposes
- Reverse engineer or extract the source code
7. Intellectual Property
The ApiSwiss application, its logo, content and source code are the exclusive property of Flowbiz Sàrl. Any unauthorised reproduction is prohibited. Beekeeping data entered by the user belongs to the user.
8. Limitation of Liability
ApiSwiss is provided "as is". Flowbiz Sàrl cannot be held liable for:
- Data loss due to technical failure
- Temporary service interruptions
- Beekeeping decisions made on the basis of application data
Flowbiz Sàrl's liability is limited to the amount of subscriptions paid in the last 12 months.
9. Termination
You may delete your account at any time from the application. Flowbiz Sàrl reserves the right to suspend or terminate any account in case of breach of these Terms.
10. Applicable Law
These Terms are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the Canton of Fribourg, Switzerland.
11. Changes
Flowbiz Sàrl may modify these Terms at any time. Users will be notified at least 30 days before material changes take effect.
